Terms of Service 

Welcome to Whaletail Sales (“Company,” “we,” “our,” or “us”). By accessing or using our website, purchasing products, or interacting with our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use this website. 

Whaletail Sales specializes in authentic aircraft components and aviation-inspired items. Many products are reclaimed from retired aircraft and may exhibit normal wear consistent with prior service history. 

1. Eligibility & Website Use 

You represent that you are at least 18 years old or are using this website under the supervision of a parent or legal guardian. 

You agree not to: 

  • Use the website for any unlawful purpose 

  • Upload or transmit malicious code or attempt to disrupt website functionality 

  • Copy, reproduce, distribute, or resell our content, product listings, or images without prior written permission 

  • Attempt unauthorized access to restricted areas of the website 

  • Scrape, harvest, or collect customer data 

We reserve the right to suspend or terminate access for violations of these Terms. 

2. Product Nature & Condition 

Unless explicitly stated in writing: 

  • Products are retired aircraft components 

  • Products are non-airworthy 

  • Products are sold for display, collection, novelty, or training purposes only 

  • No item is certified for flight use 

All products are sold “as-is, with visible wear consistent with aviation service history. No restoration or refurbishment is implied unless specifically described. 

3. Orders & Availability 

All products are subject to availability. Many items are one-of-a-kind. 

We reserve the right to: 

  • Refuse or cancel any order at our discretion 

  • Limit quantities per customer 

  • Cancel orders suspected to be placed by unauthorized resellers 

You agree to provide accurate and complete billing and shipping information. Orders may be canceled if inaccurate information is provided.

4. Pricing & Errors 

Prices are subject to change without notice. We reserve the right to correct: 

  • Typographical errors 

  • Incorrect pricing 

  • Inaccurate descriptions 

If an error is identified after an order is placed, we may cancel the order and issue a full refund.

5. Fulfillment 

Orders are fulfilled in the order received. 

Delivery timelines depend on: 

  • Order volume 

  • Fulfillment queue position 

  • Product availability 

  • Whether the item is already removed from an aircraft 

Delivery time estimates begin once the package has shipped, not when the order is placed.

6. Shipping Costs 

Shipping costs are the customer’s responsibility. The cost will be included in the final price provided to you, at time of purchase. 

We ship internationally. International customers are responsible for any import duties, taxes, customs fees, or other charges imposed by their country.

7. Regular Shipment, Freight & Oversized Shipments 

Due to the size and weight of many items, freight shipping is often required. 

Delivery Requirements 

By purchasing a freight-shipped item, you acknowledge and agree that you are responsible for ensuring the delivery location: 

  • Can accommodate a freight truck 

  • Has adequate access and space 

  • Has appropriate personnel and/or equipment to unload the shipment 

Liftgate service or special handling must be requested in advance and may result in additional charges. 

Missed Deliveries 

Missed appointments may result in: 

  • Redelivery fees 

  • Storage charges 

  • Return freight costs 

These charges are the responsibility of the customer. 

Inspection Upon Delivery 

You must inspect freight shipments at delivery. Any visible damage must be: 

  • Noted on the delivery receipt 

  • Photographed 

  • Reported to us within 24 hours 

Failure to properly document damage may void freight claims. 

Carrier Responsibility 

Once transferred to the carrier, responsibility for transportation rests with the carrier. Whaletail Sales is not liable for: 

  • Freight delays 

  • Handling damage 

  • Transit-related issues 

We will assist with freight claims but do not control carrier operations. 

Freight shipments are curbside delivery only unless otherwise agreed in writing. 

8. Returns, Refunds & Warranty 

Due to the rarity, size, historical nature, and logistics of our inventory: 

All sales are final. 

Refunds, replacements, or store credit may be considered on a case-by-case basis at our sole discretion. 

To request consideration: 

  • You must contact us within 7 days of delivery 

  • The item must remain in the same condition as received 

  • Any approved return must be properly packaged and insured 

Freight charges, return shipping costs, and handling fees are non-refundable unless otherwise agreed in writing. 

Custom, modified, or made-to-order items are not eligible for return, refund, or exchange.

No Warranty 

All products are sold without warranties of any kind, express or implied. 

9. Third-Party Services 

Our website is hosted on Shopify. We utilize third-party providers for payment processing and shipping services. 

We are not responsible for errors, outages, or disruptions caused by third-party service providers. 

10. Customer Content & Media 

If you submit reviews, photos, videos, or tag Whaletail Sales in social media content featuring our products, you grant us a non-exclusive, royalty-free, perpetual license to repost and use that content for marketing purposes unless you request otherwise in writing. 

11. Accuracy of Information 

We strive for accuracy but do not guarantee that website content is complete, current, or error-free. Information provided on the site is for general informational purposes only. 

12. Disclaimer of Warranties 

All products and services are provided “as-is” and “as available.” 

We do not guarantee: 

  • Uninterrupted website operation 

  • Error-free listings 

  • That products will meet individual expectations 

To the fullest extent permitted by law, Whaletail Sales disclaims liability for: 

  • Indirect, incidental, or consequential damages 

  • Lost profits or business interruption 

  • Data loss 

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

13. Indemnification 

You agree to indemnify, defend, and hold harmless Whaletail Sales from any claims, damages, liabilities, or legal expenses arising from: 

  • Your violation of these Terms 

  • Your misuse of any product 

  • Your violation of any law or third-party rights 

14. Governing Law & Jurisdiction 

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. 

Any disputes shall be resolved exclusively in the state or federal courts located in Arizona, and you consent to the jurisdiction of those courts. 

15. Changes to These Terms 

We reserve the right to modify these Terms at any time. Updates will be effective upon posting. Continued use of the website constitutes acceptance of any revised Terms.
